4、petitions for review of staff action. (a) When an electronically filed record which has been submitted to the Department under this subpart, is dis-approved (rejected), or a special tariff permission is approved or denied, under authority assigned by the Department of Transportations Regulations, 14

5、 CFR 385.13, such actions shall be under-stood to include the following provi-sions: (1) Applicable to a record or records which is/are disapproved (rejected). The record(s) disapproved (rejected) is/are void, without force or effect, and must not be used. (2) Applicable to a record or records which

6、 is/are disapproved (rejected), and to special tariff permissions which are ap-proved or denied. This action is taken under authority assigned by the De-partment of Transportation in its Or-ganization Regulations, 14 CFR 385.13. Persons entitled to petition for review of this action pursuant to the

7、Depart-ments Regulations, 14 CFR 385.50, may file such petitions within seven days after the date of this action. 10、 direct foreign air carrier and surface transportation to or from any point within the United States (hereafter referred to as inter-modal cargo services). 222.2 Scope of permissible inter-modal cargo services. (a) Under its foreign air carrier per-mit, a direct foreign air carrier may provide or co

11、ntrol the surface portion of intermodal cargo services within a zone extending 35 miles from the boundary of the airport or city it is au-thorized to serve. A direct foreign air carrier shall not provide or control the surface portion of intermodal cargo services outside of this 35-mile zone un-less

12、 authorized to do so by the Board in accordance with 222.3, 222.4 and 222.5. (b) A direct foreign air carrier shall be considered to control the surface portion of intermodal cargo services if it has or publicly represents that it has any responsibility for or control over the movement of, or has an

13、y owner-ship, controlling or exclusive dealing relationship with, the carrier actually providing the surface transportation. (c) Except as provided in paragraphs (a) and (b) of this section with respect to control by a direct foreign air car-rier, any U.S. or foreign indirect air carrier, surface ca

15、freight forwarder may provide the sur-face portion of intermodal cargo serv-ices without limitation as to geo-graphic area within the United States. (d) The Board may withdraw the au-thority of an indirect foreign air car-rier to provide the surface portion of intermodal cargo services, or the au-th

16、ority of a direct foreign air carrier to offer intermodal cargo services pursu-ant to joint fares with other carriers providing the surface transportation, at any time, with or without hearing, if the Board finds it in the public inter-est. 222.3 Application for Statement of Authorization. (a) Appli

17、cation for a Statement of Authorization shall be filed with the Boards Regulatory Affairs Division, Bureau of International Aviation, in duplicate, on CAB Form 222 (obtainable from the Civil Aeronautics Board, Pub-lications Services Division, Wash-ington, D.C. 20428), attached as Appen-dix A. In mos

18、t cases the Board will act upon applications for Statements of Authorization within 60 days. (b) Persons objecting to an applica-tion for a Statement of Authorization shall file their objections with the Reg-ulatory Affairs Division, Bureau of International Aviation, within 28 days of the filing dat

19、e of the application. The Board will list the names and na-tionalities of all persons applying for Statements of Authorization in its Weekly Summary of Filings. (c) An application shall include a copy of any bilateral agreement, memorandum of consultations, or dip-lomatic note or letter, in support

20、of the authority requested. Documents that appear in official U.S. publica-tions may be incorporated by ref-erence. 21、receipt of appli-cation for Statement of Authoriza-tion. (a) After review of an application form filed under 222.3, the Board will take one or more of the following ac-tions: (1) Indicate by stamp on CAB Form 222 the effective date of the Statement of Authorization, and return to the car-rier the du

22、plicate copy of Form 222 as evidence of approval under this part; (2) Request additional information from the applicant; (3) Set the application for notice and hearing procedures; (4) Disapprove the application or ap-prove it subject to such terms, condi-tions, or limitations as may be re-quired by

23、the public interest; or (5) Reject the application on the grounds that there is no agreement by the United States authorizing the pro-posed services. (b) An order disapproving an applica-tion or subjecting it to conditions or limitations shall be transmitted to the President for stay or disapproval.

24、 If the President does not stay or disapprove the Boards order, it shall become ef-fective on the 31st day after trans-mittal to the President, or within any longer time period established in the order. 222.5 Cancellation or conditioning of a Statement of Authorization. A Statement of Authorization

25、may be canceled or made subject to addi-tional terms, conditions, or limita-tions, at any time, with or without hearing, if the Board finds that it is in the public interest to do so. An order canceling or conditioning a Statement of Authorization shall be submitted to the President for stay or disa

26、pproval and shall become effective on the 31st day after transmittal or within any longer time period established by the Board.
