17、, Auto-bahnen, Bahnhfe, Flughfen, Stromtrassen sowie Kraft- und Energiespeicherwerke bilden den Grundstein fr Wachstum, Arbeitspltze und Wohlstand in Deutschland. Gleichwohl stoen sie in Teilen der Bevlkerung zunehmend auf Kritik. Das gesellschaftliche Klima, in dem Infrastruktur-projekte geplant un

18、d umgesetzt werden, ist im Wandel begriffen. In der Bevlkerung hat sich ein neues Legitimationsverstndnis entwickelt: in mo-dernen Gesellschaften werden Entscheidungen nicht mehr automatisch als legitim empfunden, nur weil sie formal rechtmig zustande gekommen sind. Es bedarf zudem einer ffentlichke

19、itsbeteili-gung, die die Sinnhaftigkeit und den Nutzen eines Vorhabens vermittelt. Die Legitimation von Infra-strukturprojekten beruht auf einer neuen Verfah-rensqualitt, die andere Merkmale erfllen muss als die formalen Verfahren alleine, auch wenn sie diese voraussetzt. Vorhabentrger, planende und

20、 ausfhrende Ingeni-eure sowie weitere Beteiligte mssen sich auf diese vernderten Rahmenbedingungen fr Infrastruktur-, Industrie- und Bauprojekte einstellen. Dies ist nicht nur aus Grnden des gesellschaftlichen Zu-sammenhalts geboten, sondern auch konomisch sinnvoll. Denn ausufernde Konflikte und Rec

21、hts-verfahren im Umsetzungsprozess haben nicht nur infrastrukturelle Modernisierungslcken zur Folge, sondern verursachen auch enorme betriebs- und volkswirtschaftliche Kosten. Frhzeitige und um-fassende Kommunikation und ffentlichkeitsbetei-ligung legitimieren auf gesellschaftlicher Ebene die inhalt

22、liche Angemessenheit der technischen Lsung des Projekts und senken damit die Wahr-scheinlichkeit eskalierender Konflikte. Daher sind sie der Effizienz und Effektivitt von Bauprojekten zutrglich. Introduction Infrastructure projects such as railways, highways, train stations, airports, power lines, a

23、s well as power and energy storage units form the founda-tion for growth, jobs and prosperity in Germany. However, they are increasingly met with criticism among parts of the population. The social climate in which infrastructure projects are planned and implemented is changing. People have arrived

24、at a new understanding of legitimacy: In modern soci-ety, decisions are no longer automatically per-ceived as legitimate, just because they have come about in a legal manner formally. It also requires public participation, which conveys the meaning and the benefits of a project. The legitimacy of in

25、frastructure projects is based on a new method quality that must meet different characteristics than the formal procedures alone, even if it requires these as precondition. Project sponsors, planning and executive engineers as well as other stakeholders need to adapt to these changing conditions for

26、 infrastructure, industry and construction projects. This is necessary not only for reasons of social cohesion, but also makes eco-nomic sense. One should keep in mind that escalat-ing conflicts and legal proceedings in the imple-mentation process do not only result in modernisa-tion gaps with respe

27、ct to infrastructure, but also cause huge operational and economic costs. Early and comprehensive communication and public participation legitimise at the social level content appropriateness of the technical solution of the project and thus reduce the likelihood of escalating conflicts. Therefore,

29、Themen mehr, sondern harte“, erfolgskritische Faktoren fr Infrastruktur- und Industrieprojekte. Vorhabentrger, planende und ausfhrende Ingenieure sowie die weiteren Beteiligten sollen daher bereits in der Entwick-lungsphase von Infrastrukturprojekten in den in-tensiven Austausch mit dem gesellschaft

30、lichen Umfeld treten und sich einem ernst gemeinten Dialog stellen. In dessen Mittelpunkt steht einer-seits die grundstzliche Notwendigkeit von Infra-strukturprojekten. Andererseits geht es um die gesamtgesellschaftliche Abwgung der techni-schen, wirtschaftlichen, kologischen und sozialen Auswirkung

31、en dieser Projekte. Bei Planungs- und Bauzeiten von oft mehr als zehn Jahren gengt es nicht, Fragen nach Zielen und Alternativen eines Infrastrukturprojekts einmalig zu beantworten und dann ad acta zu legen. Viel-mehr mssen alle Entscheidungen immer wieder begrndet und kommuniziert werden. Auch geng

32、t der Verweis nicht mehr, dass sich Parlamente wie-derholt und mit groer Mehrheit fr ein Projekt ausgesprochen haben. Die Legitimation durch parlamentarische Verfahren“ muss um die Legi-timation durch Kommunikation und Beteiligung“ ergnzt werden. Herkmmliche Kommunikation findet bei Infra-strukturpr

33、ojekten vor allem zwischen den Vorha-bentrgern und den Genehmigungsbehrden statt. Der Austausch erfolgt dann zwischen Antragstel-lern, Fachleuten der Genehmigungsbehrden und oft auch externen Gutachtern. Fr gesellschaftlich tragfhige Industrie- und Infrastrukturprojekte ist hingegen zustzlich ein fr

34、hzeitiger Dialog mit betroffenen Nutzern und Anwohnern sowie mit der allgemeinen ffentlichkeit notwendig. Brger wollen auch an den Entscheidungsprozessen aktiv teilhaben. Sie wollen Ziele und Varianten von Pla-nungen mitdiskutieren. Dies geht ber gesetzlich vorgeschriebene Mindestanforderungen in pu

35、ncto Kommunikation und Beteiligung hinaus und erfor-dert informelle Verfahren guter Kommunikation und ffentlichkeitsbeteiligung. So sieht auch das im Juni 2013 in Kraft getretene Gesetz zur Verbes-serung der ffentlichkeitsbeteiligung und Ver-einheitlichung von Planfeststellungsverfahren (PlVereinhG)

36、 eine Optimierung der Beteiligung durch eine sogenannte frhe Kommunikation und ffentlichkeitsbeteiligung vor. Dadurch besteht fr Vorhabentrger die Chance zum frhzeitigen Er-kennen von Konflikten und zwar bevor es nach der Auslegung und dem Errterungstermin zu Einwendungen kommt, die oft Verfahrensve

37、rzge-rungen nach sich ziehen. 25 Abs. 3 Verwaltungs-Thus, communication and public participation are not “soft” issues anymore, but “hard”, success-critical factors for infrastructure and industrial projects. Project sponsors, planning and executive engineers and other stakeholders should therefore

38、engage in the intensive exchange with the social environment already during the development phase of infrastructure projects and face a serious dia-logue. At its centre is the basis necessity for infra-structure projects. But it also involves an overall societal balancing of technical, economic, eco

39、logi-cal and social effects of such projects. In the case of planning and construction times of often more than ten years, it is not enough to an-swer questions about the objectives and alterna-tives of an infrastructure project once and then merely to file them away. Instead, all decisions must alw

40、ays be re-established and communicated. Nor is it any longer sufficient if parliaments have repeatedly and with overwhelming majorities spo-ken up in favour of a project. The “legitimation through parliamentary procedure” must be sup-plemented to include the “legitimation through communication and p

41、articipation”. Conventional communication takes place in infra-structure projects mainly between the project spon-sors and the approving authorities. The exchange then takes place between the applicants, experts of approving authorities and often also external ex-perts. Socially viable industrial an

42、d infrastructure projects, however, require an early dialogue with affected users and residents, as well as with the general public. Citizens too want to play an active role in decision-taking processes. They want to be part of the discussion of planning objectives and alternatives. This goes beyond

43、 statutory minimum requirements in terms of communication and par-ticipation and requires informal methods of good communication and public participation. Thus, the law on improving public participation and stan-dardisation of plan approval procedures (PlVereinhG), which entered into effect in June

44、2013, also provides for optimised participation through early communication and public participa-tion. This way project sponsors can detect conflicts early that is, before objections are raised follow-ing explanations and discussions that often result in procedural delays. Section 25 para. 3 of the

45、draft Administrative Procedure Act does not specify how early communication and public participation should be realised; the provision allows for some leeway in the implementation. 46、r Ingenieure e.V., Dsseldorf 2014 verfahrensgesetzentwurf bestimmt nicht, wie die frhe Kommunikation und ffentlichkeitsbeteili-gung durchzufhren ist; die Bestimmung lsst Ge-staltungsspielraum bei der Umsetzung zu. Ziel aller Kommunikations- und Beteiligungsbe-mhungen muss es sein, Brgerinnen und Brg

47、er vor Ort sowie organisierte Interessen wie lokale Verbnde, Nichtregierungsorganisationen und Brgerinitiativen bei Infrastrukturprojekten als Partner zu gewinnen, um gemeinsam gesellschaft-lich tragfhige und gleichermaen breit akzeptierte Lsungen zu finden. Hierzu leistet die folgende Richtlinie ei

48、nen Beitrag. In ihr finden sich in kom-primierter Form Grundprinzipien und Standards, wie eine gute Kommunikation und ffentlich-keitsbeteiligung gestaltet werden soll. Das Einhal-ten dieser Richtlinie bietet jedoch keine Garantie, angestrebte Konsenslsungen bei Infrastruktur-projekten in jedem konkr

49、eten Fall zu erreichen. Dies ist aufgrund der Vielzahl unterschiedlicher Interessenlagen schwierig. Die Anwendung dieser Richtlinie macht gesellschaftlich tragfhige L-sungen einfacher und wahrscheinlicher. Die beschriebenen Inhalte wurden in der VDI-Gesellschaft Bauen und Gebudetechnik erarbeitet und im Rahmen eines Kongresses im Oktober 2012 mit der Fachffentlichkeit diskutiert 1 so-wie im Tagungsband zum 26.
