8、dy of accepted knowledge about the mechanical regulations set forth in the BOCA National Mechanical Codel1993. Thus, it is intended as a comprehensive, convenient source of basic information for anyone who is serious about effective code enforcement. Its use is intended for persons new to the BOCA C

9、ode, as well as for the more experienced persons. In an industry as broad and encompassing as code enforcement, even the established professional has a need for reliable referral sources or to learn about less familiar topics. The reader will find particular emphasis on the codes accountability in g

10、eneral. Each sections narrative includes a statement of its objective and intent, and usually includes a discussion about why the requirement commands the conditions set forth. Giving credence to the comments are further discussions about when the requirement is used, enforcement guidelines and the

11、consequences of not adhering to the code. Discussions which provide insight to the reader by giving historical and technical background information are included as well. Reference lists and bibliographies that access a broad range of literature and the sources of information available in the industr

12、y have been included. Readers should note that the Commentary is to be used in conjunction with the BOCA National Mechanical Code11993 and not as a substitute for the code. At the time of printing, the commentary reflects the most up-to-date text of the BOCA National Mechanical Codell993. A list of

13、all errata to the BOCA National Mechanical Code11993 is published annually in the BOCA magazine. The Commentary should not be adopted as a code by a governmental jurisdiction. The illustrations should be viewed as advisory by providing assistance in interpreting the code. They do not necessarily ill

14、ustrate the only method of achieving code compliance. It is also important to explain that the commentary is advisory only, and that the code official alone possesses the authority and responsibility for interpreting the code. The format of the commentary includes the full text of each section, tabl

15、e and figure in the code, followed immediately by the commentary applicable to that text. Code text and commentary text are easily distinguished from each other. All code text is either fully shaded or surrounded by a shaded border, and all commentary text is unshaded and begins with the symbol . De

26、84 962 Chapter 1: Administration Abstract This chapter contains provisions for the application, enforce- ment and administration of subsequent requirements of this code. In addition to establishing the scope of the code, Chapter 1 identifies which mechanical equipment, appliances and sys- tems come

27、under its purview. Sections M-101.0 and M-102.0 establish the scope and applicability of the code and address existing equipment and systems. Section M-103.0 addresses existing mechanical systems and the repair and maintenance thereof. Section M- 104.0 establishes the validity of the code and its re

28、lation to other laws, statutes and ordinances. Sections M-105.0 and M-106.0 state the duties, rights and responsibilities of the code official and the mechanical inspec- tion department. Seclion M- 107.0 establishcs the approval authority of the code official and the mcchanical inspection department

29、, including the right to make modifications to code provisions and to approve alternative materials and uscd materials. Sections M-108.0 and M-109.0 deal with the administrative aspccts of code enforcernent relative to permit application and issuance. Sections M-i 10.0 and M-111.0 address the demoli

30、tion and relocation of existing structures. Section M-112.0 sets forth the conditions of a permit relative to code compliance. Section M- 11 3.0 addrcsses permit fees. Section M-114.0 ad- dresses the required inspections, the procedures for such inspec- tions, and the rights and responsibilities of

31、the code officiai. Section M-115.0 pertains to the execution of work as it may affect code compliance. Section M- i 16.0 establishes what con- stitutcs a violation of the code and what actions are to be taken by the code official and the violator. Section M-117.0 establishcs the stop work order proc

The official charged with the administration and enforcement of mcchanical regulations has a great responsibility, and with this r

36、esponsibility goes authority. No matter how detailed the mechanical code may be, the code official must, to some extent, excrcise judgement in determining compliance with the code. The code official has the responsibility to ensure that the homes in which the citizens of the community reside and the

37、 buildings in which they work are designed and constructed to be reasonably free from hazards associated with the presence and utilimtion of mechanical equip- ment, appliances and systems. The code intends to establish a minimum acceptable level of safety. General Comments The law of building regula

38、tion is grounded on the police power of thc state. This police power is the source of all authority to enact building regulations. In terms of how it is used, police power is the power ol the state to legislate for the general welfare of its citizens. This power enables passage of such laws as a mec

39、hanical code. It is from the police power delegated by the state legislature that local govern- ments are able to enact building regulations. If the mte legisla- ture has limited this power in any way, the municipality may not exceed these limitations. While the municipality may not furthcr delegate

40、 its police power (e.g., by delegating the burden of determining code com- pliance to the building owner, contractor or architect), it may turn over the administration of building regulations to a municipal official such as a code official, provided that sufficient criteria are given the code offici

41、al to establish clearly the basis for decisions as to whether or not a proposed building, including its mechanical systems, conforms to the code. Chapter 1 of the code is largely concerned with maintaining “due process of law” in enforcing the performance criteria contained in the body of the code.

M-101.1 Title: The

44、se regulations shall be known as the Mechanical Code of NM OF JURWXTK?N hereinafiar referred to as “this code.” H The purpose of this section is to insert the name of the adopting jurisdiction into the code. 45、 of the code is primarily focused on heating, ventilating and air conditioning (HVAC) systems, those items specifically addressed in the code and those building “service” items that make a building occupi- able with respect to comfort, function and safety. All mechanical equipment and systems which

46、are specifically intended, designed and necessary for the general safety and well being of the occupants of a building are intended to be governed by the code. The code intends to regulate any and all equipment and appliances that can affect the health, safety and welfare of building occupants insof

47、ar as the occupants are affected by the installation, operation and maintenance of such equipment and appliances. The intent becomes important in the application of such sections as Sections M-103.0, M-106.6, M-107.4, M-115.0 and M-119.0 as well as any enforcement-oriented interpretive action or judgement. H This section sets forth the a

49、dministrative provisions for ap- plying the code to various conditions related to the installation and use of new and existing mechanical systems. H An existing mechanical system is generally considered to be “grandfathered” with code adoption, provided that the system meets a minimum level of safety. Frequently the criteria for this level are the regulations (or code) under which the existing building was originally constructed
