Die zustndige Behrde kann auf schriftlichen Antrag des Arbeitgebers Ausnahmen zulassen, wenn der Arbeitgeber eine andere, ebenso wirksame Manahme trifft oderdie Durchfhrung der Vorschrift im Einzelfall zu eine

33、r unverhltnismigen Hrte fhren wrde und die Abweichung mit dem Schutz der Arbeit-nehmer vereinbar ist.Auf Grundlage der ArbStttV und der ASR werden in dieser Richtlinie ergnzende Hinweise und alterna-tive Empfehlungen gegeben, wie Sanitrrume in Ar-beitssttten beschaffen sein sollen.Anmerkung: Die neu

34、en Technischen Regeln zu den Sanitrrumen werden derzeit vom Ausschuss fr Arbeitssttten erarbeitet und lie-gen noch nicht vor. Die Richtlinie bezieht sich daher auf die Ar-beitsstttenrichtlinien ASR 34/1-5, ASR 35/1-4, ASR 35/5, ASR 37/1 und ASR 38/2. Diese Richtlinien wurden auf Grund der Arbeitsstt

35、tenverordnung von 1975 erarbeitet und vom zustndigen Bundesministerium im Bundesarbeitsblatt verffentlicht. Sie gelten bis zur berarbeitung bzw. 39、 and the German Work-places Guideline (Arbeitsstttenrichtlinie or ASR) apply to the planning, construction and operation of sanitary facilities in the workplace. The responsible authorities may grant waivers following receipt of a written application by the employer ifthe employer implements differe

40、nt, equally effec-tive measures, orimplementation of the regulations would in the in-dividual case result in disproportionately severe consequences, and the deviation can be reconciled with the protection of the employees.On the basis of the ArbStttV and ASR, the present guideline provides supplemen

41、tary information and alternative recommendations on the design of sani-tary facilities in the workplace.Note: New technical rules for sanitary facilities are currently being formulated by the Committee on Workplaces and are not yet avail-able. For this reason this guideline relates to these workplac

42、e guide-lines: ASR 34/1-5, ASR 35/1-4, ASR 35/5, ASR 37/1 and ASR 38/2. These guidelines were drawn up on the basis of the Workplaces Ordinance of 1975 and published in the Federal Labour Gazette by the federal ministry responsible.
