(a) Any air carrier or foreign air car-rier desiring special authorization to provide free or reduced-rate foreign air transportation to perso

    2、ns to whom the carrier would not otherwise be author-ized to furnish such transportation under the previous provisions of this part may apply to the Board, by letter or other writing, for such authoriza-tion. (b) The application shall include the following information: (1) The identity of the person

    3、s to whom the transportation is to be fur-nished; (2) The points between which the transportation is to be furnished; (3) The approximate time of depar-ture; and (4) The carriers reasons for desiring to furnish such transportation. (c) No transportation for which ap-proval is required shall be furni

    4、shed by the carrier until that approval is re-ceived by the carrier. (Approved by the Office of Management and Budget under control number 30240002) 223.24 Transportation of empty mail bags. Any carrier authorized to engage in foreign air transportation may trans-port in foreign air transportation e

    5、mpty air mail bags from any country to the country of origin of such bags, free of charge, on a voluntary space- available basis. 223.25 List of affiliates. (a) Each carrier shall maintain at its principal office a list containing all of that carriers affiliates, showing the exact relationship of ea

    6、ch affiliate to the carrier. (b) No pass may be issued under 223.22(a) to a director, officer, em-ployee, or members of their immediate family, of any affiliate, unless that af-filiate is on the list required by para-graph (a) of this section. (c) The list required by paragraph (a) of this section s

    9、2.1 Applications for review. (a) Any person who would be ag-grieved by an order of the Postmaster General issued under and within the meaning of section 41902 of the Statute may, within not more than 10 days after the issuance of such order, apply to the Department for a review thereof. (b) An appli

    10、cation for review filed under this part shall be made in writ-ing and shall be conspicuously entitled Application for Review of Order of the Postmaster General under section 41902 of the Statute. Except as otherwise provided in paragraph (c) of this sec-tion, such application for review shall specif

    11、y: (1) The schedule affected and identity of the order complained of; (2) The manner in which the appli-cant is or would be aggrieved by the order; (3) The relief sought; (4) The facts relied upon to establish that the public convenience and neces-sity require that such order be amend-ed, revised, s

    12、uspended, or canceled by the Department; (5) An estimate of the total economic impact (including nonmail revenues) on the carrier of complying with the Postmaster Generals order; (6) A history of the flight or flights in question and any predecessor flights cooperated in the market at or about VerDa

    14、ing when they were first operated and whether they have been operated continuously since that time: Provided, That this history need not extend beyond the last three years; (7) A detailed statement of the rea-sons for the schedule change, including copies of any economic data considered by carrier m

    15、anagement in reaching that determination; (8) Any other schedule changes in the affected market which accompany the schedule change in question, or a state-ment to the effect that there are no such changes; (9) Monthly load-factor data on the flight or flights in question for the most recent twelve-

    16、month period; (10) Profit and loss data for the flight or flights in question for the most re-cent twelve-month period, provided that the data be submitted on a fully allocated cost by functional account number or by some other method in which costs are determined on a fully allocated basis and whic

    17、h is explained in complete detail; and (11) A statement indicating whether the carrier is willing to seatload sack mail on the flight or flights in ques-tion. (c) Where the application is for re-view of an order which does not involve disapproval, alteration, or amendment of a change or changes whic

    19、ns for re-view. (a) Any interested person may, with-in not more than ten days after the fil-ing of an application for review, serve and file with the Department an an-swer in opposition to, or in support of, such applications. Such answer shall set forth the economic data and other facts upon which

    20、it is based. (b) An answer of the Postmaster Gen-eral or U.S. Postal Service shall con-tain the following particular informa-tion, where applicable: (1) The Postal Services critical time frame for the movement of the mail in question together with a detailed ex-planation of the operational factors w

    21、hich support that estimate; (2) The alternate air and surface serv-ices (including air taxi service) avail-able in the market in question together with a statement of the costs of using such alternate services and, where ap-propriate, an explanation of why such services are unacceptable; (3) An esti

    22、mate of the average amount and expected actual density of mail which will be tendered to the car-rier if the order in question is upheld; (4) An estimate of the amount and type of containers which will be ten-dered to the carrier if the order in question is upheld; (5) The volume (including density

    23、of mail, amount and types of containers) of mail historically carried on the flight or flights in question; (6) An estimate of the volume (in-cluding density of mail, amount and types of containers) of mail histori-cally carried on the flight or flights in question which could be accommodated on oth

    24、er flights serving the market without significant impairment of service under the mail delivery time standards of the Postal Service, to-gether with an explanation of how that estimate was computed; and (7) An estimate of the impact of the flight or flights in question on mail de-livery time standar

(b) An application for postp

    30、onement of the effective date filed under this part may be made in writing or by tele-gram, and shall be conspicuously enti-tled Application for Postponement of the Effective Date of Order of the Post-master General Pending Review Under section 41902 of the Statute. Such ap-plication for postponemen

    31、t shall speci-fy: (1) The schedule affected and identity of the order complained of; (2) The manner in which the appli-cant is or would be aggrieved by the order; (3) The relief which will be sought; (4) That the applicant intends to file a timely application for review of the order under 232.1; and

    32、 (5) A summary of the justification and facts relied upon to establish that the stay should be granted. (c) Any interested person may, with-in not more than four calendar days after the service of an application for postponement of the effective date, serve and file with the Department an answer in

    33、opposition to, or in support of, the application: Provided, That if the final day of the four day period is a Saturday, Sunday, or holiday for the Department, the application may be filed with the Department no later than the end of the next day which is neither a Saturday, Sunday, or holi-day: Prov

(a) An application, answer or reply filed hereunder shall be deemed to have been filed on the date on which it is ac-tually received by the Department at its offices in Washington, D.C. (b) At the time a written or tele-graphic application, answer, or reply is f

    36、iled under this part, a copy thereof shall be served by personal service, reg-istered mail, or telegraph upon the Postmaster General and upon the air carrier operating or ordered to operate the mail service in question. Except in the case of telegraphic delivery each copy so served shall be accompan

    37、ied by a letter of transmittal stating that such service is being made pursuant to this section. In the case of telegraphic delivery the copy shall be accompanied by a telegraphic statement that service is being made pursuant to this section. (c) The execution, number of copies, and verification of

    38、a written applica-tion, answer, or reply filed under this part, and the formal specifications of papers included in such application, an-swer, or reply shall be in accordance with the requirements of the Rules of Practice relating to applications gen-erally (see part 302 of this chapter). 41 FR 4947
