    1、972 14 CFR Ch. I (1111 Edition) 39.19 39.19 May I address the unsafe condi-tion in a way other than that set out in the airworthiness directive? Yes, anyone may propose to FAA an alternative method of compliance or a change in the compliance time, if the proposal provides an acceptable level of safe

    2、ty. Unless FAA authorizes other-wise, send your proposal to your prin-cipal inspector. Include the specific ac-tions you are proposing to address the unsafe condition. The principal inspec-tor may add comments and will send your request to the manager of the of-fice identified in the airworthiness d

    3、i-rective (manager). You may send a copy to the manager at the same time you send it to the principal inspector. If you do not have a principal inspector send your proposal directly to the man-ager. You may use the alternative you propose only if the manager approves it. 39.21 Where can I get inform

    4、ation about FAA-approved alternative methods of compliance? Each airworthiness directive identi-fies the office responsible for approving alternative methods of compliance. That office can provide information about alternatives it has already ap-proved. 39.23 May I fly my aircraft to a re-pair facil

    5、ity to do the work re-quired by an airworthiness direc-tive? Yes, the operations specifications giving some operators authority to op-erate include a provision that allow them to fly their aircraft to a repair fa-cility to do the work required by an airworthiness directive. If you do not have this a

    6、uthority, the local Flight Standards District Office of FAA may issue you a special flight permit unless the airworthiness directive states oth-erwise. To ensure aviation safety, FAA may add special requirements for oper-ating your aircraft to a place where the repairs or modifications can be accom-

    7、plished. FAA may also decline to issue a special flight permit in particular cases if we determine you cannot move the aircraft safely. 39.25 How do I get a special flight permit? Apply to FAA for a special flight per-mit following the procedures in 14 CFR 21.199. 39.27 What do I do if the airworthi

    8、-ness directive conflicts with the service document on which it is based? In some cases an airworthiness direc-tive incorporates by reference a manu-facturers service document. In these cases, the service document becomes part of the airworthiness directive. In some cases the directions in the servi

    9、ce document may be modified by the air-worthiness directive. If there is a con-flict between the service document and the airworthiness directive, you must follow the requirements of the air-worthiness directive. (a) Except as provided in paragraphs (b) and (d) of this section, this part pre-scribes rules governing

    18、 the mainte-nance, preventive maintenance, re-building, and alteration of any (1) Aircraft having a U.S. airworthi-ness certificate; (2) Foreign-registered civil aircraft used in common carriage or carriage of mail under the provisions of Part 121 or 135 of this chapter; and (3) Airframe, aircraft e

    19、ngines, propel-lers, appliances, and component parts of such aircraft. (b) This part does not apply to (1) Any aircraft for which the FAA has issued an experimental certificate, unless the FAA has previously issued a different kind of airworthiness certifi-cate for that aircraft; or (2) Any aircraft

    20、 for which the FAA has issued an experimental certificate under the provisions of 21.191 (i)(3) of this chapter, and the aircraft was pre-viously issued a special airworthiness certificate in the light-sport category under the provisions of 21.190 of this chapter. (c) This part applies to all life-l

    21、im-ited parts that are removed from a type certificated product, segregated, or controlled as provided in 43.10. (d) This part applies to any aircraft issued a special airworthiness certifi-cate in the light-sport category except: (1) The repair or alteration form specified in 43.5(b) and 43.9(d) is

    22、 not required to be completed for products not produced under an FAA approval; (2) Major repairs and major alter-ations for products not produced under an FAA approval are not required to be recorded in accordance with appendix B of this part; and (3) The listing of major alterations and major repai

    25、nless (1) Using methods, techniques, and practices acceptable to the Adminis-trator, it has been disassembled, cleaned, inspected, repaired as nec-essary, and reassembled; and (2) It has been tested in accordance with approved standards and technical data, or in accordance with current standards and

    26、 technical data accept-able to the Administrator, which have been developed and documented by the holder of the type certificate, supple-mental type certificate, or a material, part, process, or appliance approval under 21.305 of this chapter. (b) No person may describe in any re-quired maintenance

    27、entry or form an aircraft, airframe, aircraft engine, pro-peller, appliance, or component part as being rebuilt unless it has been dis-assembled, cleaned, inspected, repaired as necessary, reassembled, and tested to the same tolerances and limits as a new item, using either new parts or used parts t

(a) Except as provided in this section and 43.17,

    31、 no person may maintain, re-build, alter, or perform preventive maintenance on an aircraft, airframe, aircraft engine, propeller, appliance, or component part to which this part ap-plies. Those items, the performance of which is a major alteration, a major re-pair, or preventive maintenance, are lis

    32、ted in appendix A. (b) The holder of a mechanic certifi-cate may perform maintenance, pre-ventive maintenance, and alterations as provided in Part 65 of this chapter. (c) The holder of a repairman certifi-cate may perform maintenance, pre-ventive maintenance, and alterations as provided in part 65 o

    33、f this chapter. (d) A person working under the su-pervision of a holder of a mechanic or repairman certificate may perform the maintenance, preventive maintenance, and alterations that his supervisor is authorized to perform, if the supervisor personally observes the work being done to the extent ne

    34、cessary to ensure that it is being done properly and if the supervisor is readily available, in per-son, for consultation. However, this paragraph does not authorize the per-formance of any inspection required by Part 91 or Part 125 of this chapter or any inspection performed after a major repair or

    35、 alteration. (e) The holder of a repair station cer-tificate may perform maintenance, pre-ventive maintenance, and alterations as provided in Part 145 of this chapter. (f) The holder of an air carrier oper-ating certificate or an operating cer-tificate issued under Part 121 or 135, may perform maint

    36、enance, preventive maintenance, and alterations as pro-vided in Part 121 or 135. (g) Except for holders of a sport pilot certificate, the holder of a pilot certifi-cate issued under part 61 may perform preventive maintenance on any air-craft owned or operated by that pilot which is not used under pa

    37、rt 121, 129, or 135 of this chapter. The holder of a sport pilot certificate may perform preventive maintenance on an aircraft owned or operated by that pilot and issued a special airworthiness certifi-cate in the light-sport category. (h) Notwithstanding the provisions of paragraph (g) of this sect

    38、ion, the Ad-ministrator may approve a certificate holder under Part 135 of this chapter, operating rotorcraft in a remote area, to allow a pilot to perform specific pre-ventive maintenance items provided (1) The items of preventive mainte-nance are a result of a known or sus-pected mechanical diffic

    39、ulty or mal-function that occurred en route to or in a remote area; (2) The pilot has satisfactorily com-pleted an approved training program and is authorized in writing by the cer-tificate holder for each item of preven-tive maintenance that the pilot is au-thorized to perform; (3) There is no cert

    40、ificated mechanic available to perform preventive main-tenance; (4) The certificate holder has proce-dures to evaluate the accomplishment of a preventive maintenance item that requires a decision concerning the air-worthiness of the rotorcraft; and (5) The items of preventive mainte-nance authorized

    41、 by this section are those listed in paragraph (c) of appen-dix A of this part. (i) Notwithstanding the provisions of paragraph (g) of this section, in accord-ance with an approval issued to the holder of a certificate issued under part 135 of this chapter, a pilot of an air-craft type-certificated

    42、for 9 or fewer passenger seats, excluding any pilot seat, may perform the removal and re-installation of approved aircraft cabin seats, approved cabin-mounted stretch-ers, and when no tools are required, ap-proved cabin-mounted medical oxygen bottles, provided (1) The pilot has satisfactorily com-pl

(j) A manufacturer may (1) Rebuild or alter any aircraft, air-craft engine, propel

    45、ler, or appliance manufactured by him under a type or production certificate; (2) Rebuild or alter any appliance or part of aircraft, aircraft engines, pro-pellers, or appliances manufactured by him under a Technical Standard Order Authorization, an FAA-Parts Manufac-turer Approval, or Product and P

    46、rocess Specification issued by the Adminis-trator; and (3) Perform any inspection required by Part 91 or Part 125 of this chapter on aircraft it manufacturers, while cur-rently operating under a production certificate or under a currently ap-proved production inspection system for such aircraft.
